Mn\u011b se to stalo. A pr\u00e1v\u011b tehdy jsem objevil nebankovn\u00ed \u00fav\u011bry pro podnikatele a OSV\u010c, kter\u00e9 m\u011b zachr\u00e1nily p\u0159ed existen\u010dn\u00ed kriz\u00ed. Kdy\u017e moje d\u00edlna dostala velkou zak\u00e1zku, chyb\u011bly mi prost\u0159edky na nov\u00e9 stroje. Banka m\u011b zdrtila po\u017eadavky na dokumentaci a dlouhou \u010dekac\u00ed dobou. Tento druh pojistky odpov\u011bdnosti je k dispozici u bank a poji\u0161\u0165oven a m\u016f\u017ee b\u00fdt upraven pro r\u016fzn\u00e9 situace, jako je ob\u010dansk\u00e1 odpov\u011bdnost nebo odpov\u011bdnost zam\u011bstnance za \u0161kody, kter\u00e9 mohl zp\u016fsobit zam\u011bstnavateli.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Poji\u0161t\u011bn\u00ed hmotn\u00e9 odpov\u011bdnosti zam\u011bstnance p\u0159i\u00a0v\u00fdkonu zam\u011bstn\u00e1n\u00ed<\/h2>\n\n\n\n<p>Mohli byste b\u00fdt p\u0159ekvapeni, kolik r\u016fzn\u00fdch situac\u00ed m\u016f\u017ee zp\u016fsobit \u0161kodu, i kdy\u017e se zd\u00e1, \u017ee s pen\u011bzi a \u0159\u00edzen\u00edm auta nem\u00e1te co do \u010din\u011bn\u00ed. Sta\u010d\u00ed mal\u00e1 nepozornost, a \u0161koda je na sv\u011bt\u011b. Nap\u0159\u00edklad chybn\u00fd pokyn pod\u0159\u00edzen\u00e9mu, vylit\u00e1 k\u00e1va na po\u010d\u00edta\u010di nebo ztracen\u00fd mobiln\u00ed telefon mohou zp\u016fsobit ne\u010dekan\u00e9 komplikace. Z\u00e1m\u011bna jednotek nebo p\u0159id\u00e1n\u00ed nuly do objedn\u00e1vky m\u016f\u017ee tak\u00e9 zp\u016fsobit nep\u0159edv\u00eddan\u00e9 probl\u00e9my.<\/p>\n\n\n\n<p>Mo\u017enost pojistit se t\u00fdk\u00e1 prakticky ka\u017ed\u00e9 profese, a\u0165 u\u017e je to z\u00e1konn\u00e1 povinnost, nebo zdrav\u00fd \u00fasudek a prevence. Zam\u011bstnavatel v\u0161ak v t\u011bchto situac\u00edch m\u00e1 pr\u00e1vo na takzvan\u00fd regresn\u00ed n\u00e1rok v\u016f\u010di osob\u011b, kter\u00e1 \u0161kodu skute\u010dn\u011b zp\u016fsobila. To znamen\u00e1, \u017ee zam\u011bstnavatel m\u016f\u017ee po zam\u011bstnanci po\u017eadovat n\u00e1hradu \u0161kody, kterou zaplatil, nebo jej\u00ed \u010d\u00e1st, za p\u0159edpokladu, \u017ee jsou spln\u011bny p\u0159\u00edslu\u0161n\u00e9 podm\u00ednky uveden\u00e9 v pr\u00e1vn\u00edch p\u0159edpisech.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Zam\u011bstnanec odpov\u00edd\u00e1 za \u0161kodu, kterou zp\u016fsob\u00ed, pokud jsou spln\u011bny n\u00e1sleduj\u00edc\u00ed podm\u00ednky:<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Zp\u016fsoben\u00ed \u0161kody:<\/strong> Zam\u011bstnanec mus\u00ed skute\u010dn\u011b zp\u016fsobit \u0161kodu n\u011bjak\u00e9 t\u0159et\u00ed stran\u011b. \u0160koda m\u016f\u017ee b\u00fdt majetkov\u00e1, fyzick\u00e1 nebo nemajetkov\u00e1.<\/li>\n\n\n\n<li><strong>Zavin\u011bn\u00ed: <\/strong>Zam\u011bstnanec mus\u00ed n\u00e9st vinu na zp\u016fsoben\u00ed t\u00e9to \u0161kody. To znamen\u00e1, \u017ee mus\u00ed b\u00fdt prok\u00e1z\u00e1no, \u017ee jednal nedbalostn\u011b, neopr\u00e1vn\u011bn\u011b nebo s \u00famyslem zp\u016fsobit \u0161kodu.<\/li>\n\n\n\n<li><strong>P\u0159\u00ed\u010dinn\u00e1 souvislost:<\/strong> Mus\u00ed existovat p\u0159\u00ed\u010dinn\u00e1 souvislost mezi jedn\u00e1n\u00edm zam\u011bstnance a vzniklou \u0161kodou. To znamen\u00e1, \u017ee \u0161koda mus\u00ed b\u00fdt p\u0159\u00edm\u00fdm v\u00fdsledkem \u010dinnosti zam\u011bstnance.<\/li>\n<\/ol>\n\n\n\n<p>Je d\u016fle\u017eit\u00e9 poznamenat, \u017ee existuj\u00ed ur\u010dit\u00e9 v\u00fdjimky a omezen\u00ed odpov\u011bdnosti zam\u011bstnance, a ty mohou b\u00fdt stanoveny pr\u00e1vn\u00edmi p\u0159edpisy nebo smlouvami mezi zam\u011bstnancem a zam\u011bstnavatelem. V n\u011bkter\u00fdch p\u0159\u00edpadech m\u016f\u017ee zam\u011bstnavatel p\u0159evz\u00edt odpov\u011bdnost za \u0161kodu sv\u00fdch zam\u011bstnanc\u016f v r\u00e1mci sv\u00e9ho poji\u0161t\u011bn\u00ed odpov\u011bdnosti zam\u011bstnavatele. Odpov\u011bdnost zam\u011bstnance za \u0161kodu se m\u016f\u017ee li\u0161it v z\u00e1vislosti <a href=\"https:\/\/www.zakonyprolidi.cz\/hledani?text=zakonik%20prace\" target=\"_blank\" rel=\"noopener\">na pr\u00e1vn\u00edch p\u0159edpisech v dan\u00e9 zemi<\/a>.<\/p>\n\n\n\n<p><strong>Pokud chyb\u00ed n\u011bkter\u00fd z uveden\u00fdch p\u0159edpoklad\u016f, nen\u00ed zam\u011bstnanec povinen n\u00e9st n\u00e1hradu za zp\u016fsobenou \u0161kodu.<\/strong><\/p>\n\n\n\n<p>Zam\u011bstnanci jsou skute\u010dn\u011b chr\u00e1n\u011bni pr\u00e1vn\u00edm omezen\u00edm t\u00fdkaj\u00edc\u00edm se maxim\u00e1ln\u00ed v\u00fd\u0161e n\u00e1hrady za \u0161kodu, kterou mohou b\u00fdt povinni uhradit. V\u00fd\u0161e t\u00e9to n\u00e1hrady je omezena <strong>na maxim\u00e1ln\u011b 4,5n\u00e1sobek<\/strong> pr\u016fm\u011brn\u00e9ho hrub\u00e9ho m\u011bs\u00ed\u010dn\u00edho v\u00fdd\u011blku zam\u011bstnance p\u0159ed zp\u016fsoben\u00edm \u0161kody. V praxi to znamen\u00e1, \u017ee zam\u011bstnanec s m\u011bs\u00ed\u010dn\u00ed mzdou ve v\u00fd\u0161i 36 000 K\u010d by mohl b\u00fdt povinen uhradit n\u00e1hradu \u0161kody a\u017e do \u010d\u00e1stky 156 000 K\u010d. Je t\u0159eba zd\u016fraznit, \u017ee tento z\u00e1konn\u00fd limit plat\u00ed pouze v p\u0159\u00edpad\u011b, \u017ee \u0161koda byla zp\u016fsobena nedbalost\u00ed, tedy opomenut\u00edm pracovn\u00edch povinnost\u00ed zam\u011bstnance, jak bylo uvedeno nap\u0159\u00edklad ve va\u0161em p\u0159\u00edkladu ohledn\u011b parkov\u00e1n\u00ed slu\u017eebn\u00edho auta.<\/p>\n\n\n\n<p>M\u00e1te pravdu, situace se zcela m\u011bn\u00ed, pokud jde o zp\u016fsoben\u00ed \u0161kody zam\u011bstnancem \u00famysln\u011b nebo za stavu opilosti nebo pod vlivem n\u00e1vykov\u00fdch l\u00e1tek. V t\u011bchto p\u0159\u00edpadech je zam\u011bstnanec povinen uhradit zam\u011bstnavateli skute\u010dnou \u0161kodu, kter\u00e1 mu v d\u016fsledku takov\u00e9ho jedn\u00e1n\u00ed vznikla. Tato odpov\u011bdnost m\u016f\u017ee zahrnovat n\u00e1klady na opravu \u0161kody, n\u00e1hradu za ztr\u00e1tu majetku nebo jak\u00e9koliv jin\u00e9 re\u00e1ln\u00e9 n\u00e1klady, kter\u00e9 zam\u011bstnavateli vznikly v d\u016fsledku takov\u00e9ho jedn\u00e1n\u00ed zam\u011bstnance. Je d\u016fle\u017eit\u00e9, aby zam\u011bstnanci byli v\u011bdomi t\u011bchto pr\u00e1vn\u00edch povinnost\u00ed a dodr\u017eovali pr\u00e1vn\u00ed p\u0159edpisy a intern\u00ed pravidla zam\u011bstnavatele, aby se vyhnuli riziku \u00famysln\u00e9ho zp\u016fsoben\u00ed \u0161kody nebo jedn\u00e1n\u00ed v opilosti \u010di pod vlivem n\u00e1vykov\u00fdch l\u00e1tek.<\/p>\n\n\n\n<p>Ano, m\u00e1te pravdu. Poji\u0161t\u011bn\u00ed odpov\u011bdnosti obvykle pokr\u00fdv\u00e1 \u0161kody zp\u016fsoben\u00e9 nedbalost\u00ed nebo n\u00e1hodn\u011b, ale \u00famysln\u011b zp\u016fsoben\u00e9 \u0161kody b\u00fdvaj\u00ed vylou\u010deny z poji\u0161t\u011bn\u00ed. Poji\u0161\u0165ovny obvykle neposkytuj\u00ed kryt\u00ed pro \u0161kody, kter\u00e9 byly zp\u016fsobeny z\u00e1m\u011brn\u011b, proto\u017ee poji\u0161t\u011bn\u00ed m\u00e1 za \u00fa\u010del chr\u00e1nit p\u0159ed neo\u010dek\u00e1van\u00fdmi a ne\u00famysln\u00fdmi ud\u00e1lostmi. Umysln\u00e9 \u0161kody by mohly v\u00e9st k ne\u017e\u00e1douc\u00edm situac\u00edm, kter\u00e9 by mohly zneu\u017e\u00edt syst\u00e9m poji\u0161t\u011bn\u00ed.
